Official Contests Rules

CONTEST OVERVIEW: The Institute of Culinary Education, Inc. is conducting a nationwide search for the next generation of culinary talent. Entrants will upload a video up to one (1) minute in length (“Video”) explaining why they deserve to win 1 of 4 full tuition scholarships to study at The Institute of Culinary Education in New York, New York or Los Angeles, California.

Upon entering, each eligible entrant (“Entrant”) will be randomly assigned to one of four “Teams” and his/her video will be posted to the contest website for public voting. The twenty-five (25) videos associated with each Team with the most public votes will become semifinalists and these one hundred (100) videos will be reviewed and scored by a panel of judges to determine the top five (5) videos per team, for a total of twenty (20) finalists. These finalists will compete in New York City in two skills challenges that will be shown on ABC’s The Chew, and as a result, there will be four (4) Grand Prize winners, who will each receive a full tuition scholarship to either the Culinary Arts program or Pastry & Baking Arts program (each a “Program”) at The Institute of Culinary Education in New York, New York or Los Angeles, California.

Entries must be received between March 5, 2018 at 9am ET and April 15, 2018 at 11:59pm ET (“Entry Period”). Voting will take place from March 26, 2018 at 12am ET and April 15, 2018 at 11:59pm ET (“Voting Period”). Subject to the terms herein, the twenty-five (25) videos per Team (approximately 100 in total across all four (4) Teams) that receive the highest number of fan votes will be the semifinalists (“Semifinalists”) and those videos will be submitted to a panel of judges posted on the official contest site at ice.edu/culinaryvoice (the “Contest Website”). Using the judging criteria set forth herein, a panel of judges will review the Semifinalists’ Videos and select the top five (5) Videos on each of the four (4) Teams from among the Semifinalists, and those twenty (20) Videos will be deemed finalists (“Finalists”), subject to eligibility verification. The Finalists will compete in a series of skills challenges at The Institute of Culinary Education and the results of these challenges will be shown on episodes of ABC’s The Chew (the “Show”). In each such challenge, the remaining Finalists will be taught a skill by chefs from The Institute of Culinary Education and will have that skill tested and judged by chefs from ICE and/or celebrity guests. These elimination challenges will narrow the number of Finalists, ultimately resulting in four (4) grand prize winners that will receive the Grand Prize scholarships set forth herein.

Overview of Key Date and Times

1. Sponsor: The Institute of Culinary Education, Inc., 225 Liberty Street, Third Floor, New York, New York 10281 (“ICE”).
2. Administrator: The Institute of Culinary Education, Inc., 225 Liberty Street, Third Floor, New York, New York 10281 and LeadDog Marketing Group, 440 Ninth Avenue, 17th Floor, New York, NY 10001 (“LeadDog”) (collectively, “Administrator”).
3. Eligibility: The “2018 #CulinaryVoice Scholarship Contest” (“Contest”) is open only to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older (or the age of majority in the jurisdiction of their residence, whichever is older) at the time of entry. Employees of ICE, current students who are matriculated in a diploma-granting program at ICE, alumni of ICE, employees of Administrator, American Broadcasting Companies, Inc. (“ABC”), any organizations responsible for fulfilling, administering, judging, advertising or promoting the Contest, persons involved in the production (including hosts and crew) of the Show and/or each of their respective parent, subsidiary, affiliated and successor companies, and the immediate family members and household members of such individuals, are not eligible to enter or win prize(s). “Immediate family members” shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses, regardless of where they live. “Household members” shall mean people who share the same residence at least three (3) months a year, whether related or not. Void where prohibited or restricted by law.

   Entrants may not have been convicted of a felony or a crime of moral turpitude. By entering, each Contest entrant (“Entrant”) understands and agrees that, if selected as a potential Finalist, he/she will be required to consent to a background check to verify eligibility; and, failure to sign such consents and authorizations and/or to furnish all required information will result in disqualification. In addition, ICE reserves the right in its sole discretion, to disqualify any entry/Entrant if the results of such background check reveal that a potential Finalist is not eligible to participate in the Contest or has been convicted of a felony or crime of moral turpitude, as determined by ICE in its sole discretion.

   ICE Scholarship/Grand Prize Eligibility: All 2018 #CulinaryVoice Scholarship Contest winners (“Grand Prize Winners”) must meet all ICE admission requirements by the time they are to begin attending ICE. Included among the ICE admission requirements, to qualify for acceptance, a prospective student must provide sufficient documentation that s/he is a high school graduate or has a GED. Acceptable documentation includes a copy of the student’s high school diploma (non-IEP), an official high school transcript indicating the student’s graduation date, an official college transcript indicating graduation from a post-secondary program at a regionally-accredited institution, or a copy of the student’s GED or other state-certified high school equivalency test (ex. NYS TASC Exam). Please contact an ICE Admissions Representative for further details. Additional admissions information may be found at: ice.edu/admissions-financial-aid/admissions. Such admissions requirements/information are made a part of these Official Rules and incorporated herein by reference.    If any of the Grand Prize Winners do not meet ICE’s admissions requirements within 365 days (12 months) after June 8, 2018, such Grand Prize Winner will be disqualified. In the event of the disqualification of a Grand Prize Winner, ICE and Administrator shall not have any liability or obligation to such disqualified individual, and a replacement Grand Prize Winner will be selected based on the process as set forth herein, time permitting. Scholarships in the 2018 #CulinaryVoice Scholarship Contest cannot be redeemed for cash value and are not transferable.

4. Contest Entry: All entries must be received by 9am ET on 3/5/18 (the end of the Entry Period). ICE’s computer is the official clock for the Contest. To enter, go to the official Contest Website at ice.edu/culinaryvoice.

   Your Contest Entry Form

   Step 1 (Contest Entry Form): Complete the Contest entry form on the Contest Website. You will be asked to provide your first name, last name, e-mail address, phone number, state, campus location you are applying for (New York, New York or Los Angeles, California)**, Program of interest (Culinary Arts or Pastry & Baking Arts)**, high school diploma status, housing assistance, and an attestation that you meet the Contest’s eligibility requirements (the “Entry Information”). For avoidance of doubt, the Entry Information will not have any bearing on the judging of your Video. By entering the Contest, you agree to be contacted by an admissions representative from ICE to discuss your career goals, arrange a personal tour of ICE and to answer your questions, if any. An “Entry” consists of an individual’s Entry Information and Video.

   **Be careful in choosing a campus location and Program of interest when you enter, as any changes to these selections after the Contest are subject to ICE’s approval in its sole discretion.

   Your Video

   Step 2 (Submission of Video): After completing the Entry Information, you will be asked to upload a Video up to one (1) minute in length from your phone, computer or other applicable electronic device. The Entrant must appear in the Video. Video submissions may depict cooking, baking arts, or a passion for service in the culinary or hospitality industry. Video submissions can be comical or serious, depict a sense of accomplishment, or overcoming an obstacle/adversity. They can include testimonials from others, with prior written consent from each such individual. The goal is to demonstrate to ICE the Entrant’s passion for food, service, entrepreneurial flair and/or creativity, and convey why Entrant would be a suitable candidate for a full tuition scholarship to ICE’s Culinary Arts Program or Pastry & Baking Arts Program. The Video should be well thought-out, represent a positive addition to the ICE community and last, a flair that demonstrates that an Entrant is eager to learn and will never stop learning their craft.

   VIDEO MAY NOT INCLUDE ANY MUSIC.

   As set forth below in the section on Judging, if your Video is selected as a Semifinalist as a result of public voting, your Video will be judged by the judging panel. Each Entrant must submit an original Video (DO NOT COPY OTHERS’ WORKS, IN WHOLE OR IN PART). If any other persons appear in or were involved in the creation of your Video (including without limitation person(s) who appear in a Video [whether or not they offer testimonials about you] and/or the videographer who took the Video), you agree that prior to submitting your Entry, you have obtained the written consent of each such person, granting ICE and its designees the use of each person’s name, biographical information, image and/or likeness for advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet (including without limitation, for posting on the Contest Website in connection with the Contest), and in perpetuity by ICE and its designees, without compensation (except to the extent prohibited by law) or additional consents and without prior notice, approval or inspection, and to execute specific written consent to such use if asked to do so. ICE reserves the right to request proof of these permissions in a form acceptable to ICE from you at any time. Failure to provide such proof, if requested, may result in your disqualification, at ICE’s sole discretion. If the Video includes other persons, ICE reserves the right to disqualify Entrant’s entire Entry if Entrant has not obtained the written consent of each such person prior to submission. Do NOT include personal information (e.g., your address, e-mail address or phone number) in the Video itself as the Video may be posted in conjunction with your participation in the Contest as detailed below. In addition, the Entry must be truthful, including high school diploma status as well as any representations made in the Video itself as to Entrant’s accomplishments, personal situation or otherwise.

   Video file attachment must not run more than one (1) minute in total length and may be recorded on a smart phone, camera or any other recording device, in one of the following major video formats: MP4, MOV, WMV, AVI, and FLV. All entries must be received by 11:59pm ET on 4/15/18.

   Partial or incomplete/piecemeal submissions, submissions without a Video, or Video submissions longer than one (1) minute in length will NOT be accepted. Should a prospective Entrant’s Video not meet one or more of the criteria above, ICE and Administrator reserve the right, in their sole discretion, to contact such prospective Entrant and allow him/her to resubmit his/her Video and thereby enter the Contest. For the avoidance of doubt, nothing in any way obligates ICE and/or Administrator to extend the opportunity to a prospective Entrant to resubmit his/her Video; and, ICE and Administrator will not incur any liability under any legal theory for not extending such opportunity to a given prospective Entrant for any reason. Further, resubmission of a Video does not mean that such Video will receive any different treatment and does not improve your chances of winning. If an Entrant is allowed to resubmit his/her Video, such Video will then continue through the voting process and, if applicable, the judging processes as described below. ICE and Administrator will not incur any liability under any legal theory if such resubmitted Video is not selected to become a Semifinalist or Finalist.

   CLICK THE CHECK BOX SIGNIFYING THAT YOU MEET THE CONTEST ELIGIBILTY REQUIREMENTS, HAVE READ AND AGREE TO THESE OFFICIAL RULES AND ICE’S TERMS OF USE (AVAILABLE AT ice.edu/legal). IF YOU DO NOT CHECK THE BOX INDICATING YOUR AGREEMENT TO THE ABOVE, YOU WILL NOT BE ENTERED IN THE CONTEST AND CANNOT WIN PRIZE(S).

   Upon submitting an Entry, your Entry will be randomly assigned to one of four (4) Teams. For purposes of this Contest, Teams refer to groupings of Entrants for purposes of judging, but each Entrant’s Video will be voted on and judged individually. In later rounds of the Contest, as described below, Semifinalists and Finalists will be grouped according to Team, but will be judged individually.

   LIMIT ONE (1) CONTEST ENTRY PER PERSON DURING THE ENTRY PERIOD. Multiple entries in excess of this limitation or mass entry attempts will result in disqualification of all entries by such person. Entries must be manually key-stroked; use of automated entry devices or programs is prohibited. Once submitted, an Entry cannot be modified by Entrant, and will not be returned. Personal information collected in connection with this Contest will be treated in accordance with ICE’s privacy policy, available at ice.edu/privacy.

   During the entry process, you will be asked to consent to receive admissions e-mails and contest reminders from ICE. Consenting to receive these e-mails is optional and does not have to be agreed upon in order to be eligible to participate in the Contest and does not improve your chances of winning. In the event you do consent to receive these e-mails, the use of such e-mails shall be subject to ICE’s privacy policy, and you may opt out of receiving these e-mails at any time.

5. Additional Entry Rules and Restrictions: Without limitation of ICE’s Terms of Use, by submitting an Entry, each Entrant grants ICE and its designees a perpetual, non-exclusive, irrevocable, fully-paid, royalty-free, sub-licensable and transferable (in whole or part) worldwide license to use, reproduce, transmit, display, exhibit, distribute, create derivative works based upon, publicly perform and otherwise exploit the Entry, in whole or in part, in all media formats and channels now known or hereafter devised (including without limitation, for use and display on the Contest Website and in and in connection with the Show) for any and all purposes including entertainment, news, advertising, promotional, marketing, publicity, trade or commercial purposes, all without further notice to the Entrant, with or without attribution, and without the requirement of any permission from or payment to the Entrant or to any other person or entity. Potential Finalists and Grand Prize Winners will be required to sign a Grant of Rights and Release conveying the above rights in order to be confirmed as a Finalist and Grand Prize Winner (as applicable).

   By submitting an Entry, each Entrant agrees to grant ICE and its designees the use of Entrant’s name, biographical information, photograph, image and/or likeness for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by ICE and its designees, without compensation (except to the extent prohibited by law) or additional consents and without prior notice, approval or inspection, and to execute specific written consent to such use if asked to do so.

   Without limitation of ICE’s Terms of Use, Entrant further expressly acknowledges that ICE and any other entity affiliated with this Contest do not owe him/her a duty of confidence (or fiduciary duty or the like) with regard to his/her Entry and that ICE has wide access to ideas, stories, photos, recipes, methods ,designs and other literary/artistic materials submitted to them from outside sources or being developed by their own respective employees and that such ideas/stories/recipes/methods/videos/methods/designs/literary/artistic materials may be competitive with, similar to (or even identical to) the Entry submitted by Entrant and that ICE shall have no liability to Entrant or any third party in conjunction therewith.

   Without limitation of ICE’s Terms of Use, an Entry may not contain, and ICE, in its sole discretion, may disqualify and/or remove any Entry that contains any content that: (1) violates any law or regulation; (2) violates or infringes any right of any third party, including but not limited to intellectual property rights, such as but not limited to rights of copyright, trademark or patent, or rights of publicity or privacy; (3) is defamatory, slanderous, libelous, scandalous or obscene; (4) contains any third person’s personal information, such as personal names or e-mail addresses; (5) contains any virus, bugs, or other deleterious material; (6) embodies the names or likenesses of any individuals other than Entrant unless Entrant has first obtained the prior written consent of any named/depicted/described person as set forth herein; (7) is sexually explicit; violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; contains nudity; (8) promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); (9) promotes any activities that may appear illegal, unsafe or dangerous; promotes any particular political agenda or message; (10) is obscene or offensive; (11) communicates messages or images inconsistent with the reputation, image and/or goodwill of the ICE, ABC or any other entity affiliated with this Contest; or (12) is otherwise inappropriate, objectionable, or unsuitable for the uses contemplated in these Official Rules, as determined by ICE in its sole discretion.

   VIDEO MAY NOT INCLUDE ANY MUSIC.

   ICE, LeadDog and the other Released Parties (as defined below) will not be responsible or liable for any inability to view an Entry or any part thereof due to any technical difficulty, malfunction or failure of any kind.

   Entry must be the original work of the Entrant and may not have won previous awards. By submitting an Entry, Entrant further warrants and represents that he/she and any persons appearing or who are identifiable in the Entry consent to the submission and use of the Entry in the Contest and to use of the Entry as otherwise set forth herein.

   Eligible Videos received by ICE may be posted, in whole or in part, on the Contest Website for public viewing; such posting has no effect on the judging of Videos as set forth below, except as otherwise expressly indicated below. Entrants understand and agree that Videos may be formatted, edited or otherwise converted in order to be viewable on the Contest Website. ICE reserves the right to remove any Video from the Contest Website at any time and for any reason, without liability of any kind. Except as otherwise expressly indicated below, ICE may but is not obligated to post Videos on the Contest Website; if ICE chooses to do so, such posting is for entertainment purposes only and Entrant releases and agrees to hold harmless the Released Parties (as defined below) from any and all liability associated with possible posting (or, conversely, non-posting) of his/her Video on the Contest Website, including his/her express acknowledgment that (a) if posted, posting of the Video does not constitute any representation by ICE as to Contest eligibility (see also “Voting” below); (b) if posted, the Video as posted may differ from the Video submitted by Entrant, and may not be viewable at all times, due to technological limitations/malfunctions/errors or other causes; (c) Videos may be displayed on the Contest Website in any pattern, sequence or format, and such pattern/sequence/format may or may not be rotated or varied one or more times, in ICE’s sole discretion; (d) Video may or may not be attributed to Entrant [but, if so attributed, all aspects of the attribution (such as, prominence and placement) are at ICE’s sole discretion]. Once a Video is posted on the Contest Website, ICE is under no obligation to remove a Video for any reason. FOR ALL VIDEOS POSTED ON THE CONTEST WEBSITE, THE VIDEOS REPRESENT SOLELY THE VIEWS/OPINIONS OF THE INDIVIDUAL ENTRANT AND DO NOT REFLECT THE VIEWS/OPINIONS OF ICE IN ANY MANNER. ICE AND ADMINISTRATOR DISCLAIM ANY AND ALL LIAIBLITY IN CONJUNCTION WITH POSTING OF VIDEOS ON THE CONTEST WEBSITE, INCLUDING BUT NOT LIMITED TO LIABILTY FOR MONITORING, FILTERING OR MODERATING VIDEOS. ICE AND ADMINISTRATOR WILL NOT MODIFY OR EDIT VIDEOS IN CONJUNCTION WITH ADMINISTRATION OF THE CONTEST. Without limitation of any other terms herein, by entering, Entrant agrees to indemnify and hold harmless Released Parties (as defined below) from any action or liability resulting from the possible publishing of his/her Video and/or the use of his/her Video.

6. Voting: The Voting Period to determine the Semifinalists will take place between 12am ET on 3/26/18 to 11:59pm ET on 4/15/18 and will take place on the Contest Website. ICE reserves the right, in its sole discretion, to modify the Voting Period, for any reason including but not limited to changes to production schedule and logistical reasons. When an Entrant enters, the Entrant will be given a link to their Video on the Contest Website to share on their social networks, with friends and family. [A] BE SURE TO SHARE THE SUBMISSION PAGE IN ACCORDANCE WITH THE TERMS/POLICIES OF SELECTED SOCIAL NETWORK[S]; AND [B] WHEN SHARING, USE #CULINARYVOICECONTEST TO DISCLOSE THAT YOU ARE SHARING THE SUBMISSION PAGE IN CONJUNCTION WITH PARTICIPATION IN A CONTEST SPONSORED BY ICE. Only Videos that were preliminarily determined to be eligible (such determination being non-binding and may be rescinded by ICE/Administrator at a later time without liability or obligation of any kind) according to these Official Rules will have their respective Videos posted on the Contest Website for fan voting.

   The public is invited to vote on the posted Videos during the Voting Period by clicking “Vote” in connection with the Video(s) posted that they want to vote for. Each person may only vote once each day, per device, per IP address, per Video during the Voting Period, so Entrants should encourage their “fans” to vote every day during the Voting Period. For the purposes of this Contest, a “day” is defined as beginning at 12:00:00 a.m. (midnight) ET and ending at 11:59:59 p.m. ET.

   Any attempts through technical or other means to exceed this restriction will result in such additional unauthorized votes to not count; and, if an Entrant is determined by Administrator to be involved in any action which in any way seeks to undermine the integrity or legitimacy of the vote, such Entrant will be disqualified with ICE and/or Administrator reserving the right to pursue legal sanctions against such Entrant. By way of example only, prohibited conduct includes offering any monetary or non-monetary benefit or compensation to vote (or not vote) for a given Video.

   The Administrator will tabulate the votes and display an Entrant’s rank, in real time, during the Voting period. (Such display is for informational purposes only and may be modified by ICE/Administrator without notice or liability of any kind; and, as such, an Entrant’s rank as of the end of the Voting Period does not obligate ICE/Administrator to recognize such Entrant as a Semifinalist.) The top twenty-five (25) ranked Entrants/Videos on each of the four (4) Teams (for a total of one hundred (100) across all Teams) whose Videos receives the highest number of fan votes among the Entrants according to rank (as tabulated by Administrator) when the Voting Period ends will be the Semifinalists. HOWEVER, ICE/ADMINISTRATOR RESERVE THE RIGHT TO SELECT FEWER THAN 25 RANKED ENTRANTS PER TEAM SHOULD A SUFFICIENT QUANTITY OF QUALITY ENTRIES NOT BE RECEIVED OR FOR ANY OTHER REASON, ALL WITHOUT LIABILITY OR NOTICE OF ANY KIND. The Entrants whose Videos rank from 26th place and below on any Team will not advance in the Contest. In the unlikely event of a tie for 25th place on any Team with regard to the actual amount of fan votes, all such tied Videos will be deemed Semifinalists and will move onto the judging phase of the Contest.

7. Judging: Following the close of the Voting Period, the Semifinalists’ Videos will be presented to a panel of Judges for the first phase of judging and such judging panel will be comprised of no less than eight (8) ICE chef instructors and ICE administrators (the “Judges”). The present Judges are: James Briscione, Sabrina Sexton, Michael Laiskonis, Andrea Tutunjian, Anthony Caporale, Michael Garrett, Sim Cass and Bill Telepan. The roster of judges is subject to change without notice and ICE reserves the right to add or substitute Judges of similar caliber/expertise prior to the close of the public voting, without liability or notice of any kind. The participation of the above-named individuals as Judges is not guaranteed and is subject to their availability. Entrants who make contact with any Judges to discuss their Video or the Contest will be automatically disqualified. For this first stage of judging, the Judges will review each of the 100 Semifinalist Videos (top twenty-five (25) ranked Videos on each of the four (4) Teams based on public voting) and select the top five (5) Videos on each Team according to a cumulative score. The scoring by the Judges will be based on 8 factors/criteria, each judged on a scale of 1-12 (12 being the highest) as follows:
   1. How well did the Entrant demonstrate passion for the culinary or hospitality fields?
   2. How well did the Entrant demonstrate ambition toward the culinary or hospitality fields?
   3. How well did the Entrant demonstrate creativity in the culinary or hospitality fields?
   4. Did the Entrant communicate an active practice or past participation in his/her passion at any skill level?
   5. How well does the video communicate the Entrant’s “culinary voice” or “hospitality voice”?
   6. Was the Entrant’s video content/spoken word well thought out? (Please Note - visual quality of the video will not be factored, rather, the content in the video itself.)
   7. Do you think the Entrant would be a positive addition to the ICE community?
   8. Does the Entrant give the impression that they will be a practitioner that will “never stop learning?”

   When the total scores are tabulated by the Judges, the top five (5) Videos associated with each Team with the highest scores will advance to become the Finalists, for a total of twenty (20) Finalists. The scoring sheets containing the Judges’ scoring will not be made public and will not be shared with Entrants. Entrants waive any and all rights they may have to review the scoring sheets. In the event of a tie, the Entrant with the higher “culinary voice” or “hospitality voice” criterion will be considered the winner of the tie. The Finalists, subject to verification of eligibility and compliance with these Official Rules, will travel to ICE in New York City and take part in the final skills challenges on May 11, 12 and 13, 2018 (“Finals”). Each potential Finalist will be notified by e-mail and/or phone. Failure to respond to the initial verification e-mail within 48 hours of notification or return of e-mail notification as undeliverable after 2 attempts may result in disqualification. Failure to respond to the initial verification phone call within 48 hours of notification may result in disqualification. Only one (1) message will be left (either with person answering phone, if not potential Finalist, or via voice mail). Potential Finalists will be required to sign and return within three (3) business days of notification, an Affidavit of Eligibility, Release and Indemnification, a Publicity Release where allowed by law, the necessary paperwork for a background check, as well as any release(s) from person(s) who appear in or were involved in the creation of the Video (if applicable) and ICE admissions application documents (collectively, “Contest Documents”). Affidavit will also include a Grant of Rights from potential Finalists to ICE, as detailed above. If the Affidavit of Eligibility, Release and Indemnification, and Publicity Release, or any other portions of the Contest Documents are not returned to ICE within the specified time period, the potential Finalist may be disqualified. If a potential Finalist is disqualified for any reason, there will be no prize of any kind awarded and an alternate Finalist will be selected (time permitting), i.e., the Semifinalist with the next highest Judges’ score on that Team. The process will continue until such time that all twenty (20) Finalists have been verified to participate in the Finals (time permitting).

   Finalists must be able to travel to New York City during the dates designated by LeadDog to coincide with the administration of the Finals. Administration of the Finals is currently scheduled to take place May 11 – 13, 2018; such dates subject to change. If Finalist is unable to travel during the dates designated by LeadDog to coincide with the administration of the Finals or is not available on such dates for any reason, he/she will be disqualified, will forfeit the Finalist trip (and opportunity to compete to win a Grand Prize Scholarship) without compensation of any kind and an alternate Finalist will be selected via the appropriate process described above, time permitting.

   Travel arrangements consists of: round-trip coach air transportation for each of Finalist to New York from an airport near Finalist’s residence (as selected by LeadDog in its sole discretion); two (2) nights’ standard hotel accommodations (one room, double occupancy) in the New York area (as selected by LeadDog in its sole discretion); and round-trip transportation to and from the New York area airport, hotel and tapings of the Show. Any Finalist that lives within 150 miles of the New York area (as determined by LeadDog in its sole discretion) will receive round-trip ground transportation, in lieu of air transportation, between Finalist’s residence and the hotel.

   Once travel is booked, travel dates cannot be changed unless by LeadDog in its sole discretion. Each Finalist is solely responsible for all other expenses not specified herein, including but not limited to meals/beverages, tips, taxes and hotel incidentals, as well as any necessary or desired expenses in conjunction with their travel to New York (such as baggage fees and insurance). All travel dates and arrangements are subject to change, availability and LeadDog’s approval. Administrator is not liable for any expenses incurred as a consequence of flight cancellation/delay. Certain documentation and requirements may be necessary for travel, such as photo identification. Finalist is solely responsible for any documentation and requirements and determining applicable procedures and restrictions. In addition, the Finalists may be required to present a valid credit card at the hotel at the time of check-in. Finalist must provide own transportation to and from departure airport.

   Should Finalists fail to adhere to any instructions of ICE/Administrator (including but not limited to during participation in the Finals) or engage in unruly, obnoxious, illegal, threatening, or otherwise inappropriate behavior (as determined by ICE in its sole discretion), ICE reserves the right, without further notice or warning, to terminate the trip early, in whole or in part, and send said Finalist home and take other actions as ICE deems appropriate in its sole discretion without any liability or other obligation to that Finalist.

   Finals are subject to, and ICE is not responsible for, changes to production schedule, production exigencies or delays, postponements or cancellation of the Finals. In the event a Finalist is able to participate in the Finals trip, but the Finals do not or cannot take place as scheduled or at all, for reasons including but not limited to scheduling conflicts, cancellations, postponement, location changes, an event of force majeure, or for any other reason, then ICE reserves the right to reschedule the Finals.

   Participation in the Finals has no cash value. Finalists must follow all instructions of the ICE relative to participating in the Finals and, should any Finalist fail to adhere to such instructions or engage in unruly, obnoxious, illegal, threatening, or otherwise inappropriate behavior including but not limited to harassment, interruption, heckling of other Finalists or Grand Prize Winners and/or interference with an individual’s participation in the Finals (as determined by the ICE and/or Administrator, in their sole discretion), ICE will, without further notice or warning, remove said Finalist from the Finals and/or take other actions as the ICE deems appropriate in its sole discretion so as to protect its rights, without liability or other obligation to the Finalist. If a Finalist is removed from the Finals, ICE may require that Finalist forfeit the opportunity to appear in the Finals and win any prize.

   Finalists understand and agree that, as between ABC, on the one hand, and Finalists on the other, ABC shall own any and all rights in and to the tapings of the Show in and in connection with this Contest. As such, ABC may (but are NOT obligated to) broadcast or re-broadcast, in whole or in part, in any format or medium (whether now known or hereafter developed), including the World Wide Web and Internet, the tapings of the Show in and in connection with this Contest, without notification or compensation to Finalist. Finalists further agree, upon request of ABC or the Show, and without additional compensation of any kind, to sign and return all releases and other necessary documents so as to perfect, record or affect the foregoing rights of the Show in all such tapings/segments.

8. The Finals

   The twenty (20) Finalists will be judged in the Finals by competing in up to two (2) skills challenges as set forth below. In each such skills challenge, an ICE chef instructor (to be selected by ICE in its sole discretion) will offer a 30-minute lesson on a relevant skill in the culinary arts or pastry and baking arts. Finalists do not need to know how to cook or bake to enter and participate in this Contest or to compete in the skills challenges. Finalists will be taught the skills necessary to compete in the skills challenges. Finalists will have a set amount of time to complete the skills challenge that will be based on the lesson given by the ICE chef instructor. For the first skills challenge, the Finalists will be handed a blank scoring sheet to clearly understand the nature of the challenge, what the judges of the Finals (“Finals Judges”) are looking for and how they will be scored. (The blank scoring sheet is made a part of these Official Rules and incorporated herein by reference. Should there be any discrepancy between the scoring sheet and these Official Rules, the scoring sheet will prevail, govern and control only with respect to the Finals and in all other cases these Official Rules will prevail, govern and control. The scoring sheets containing the Finals Judges’ scores (“Judges’ Scoring Sheets”) will not be made public and will not be shared with Finalists. Finalists waive any and all rights they may have to review the Judges’ Scoring Sheets.) Chefs from ICE, co-hosts of the Show and/or celebrity guests will then challenge each of the Finalists, who will be arranged according to Team, with a surprise market basket ingredient and an exercise/challenge in which the Finalists must utilize the skill taught to them by the ICE chef instructor. All Finalists on all Teams will participate in this first skills challenge. Although Finalists will be arranged according to Team, each Finalist will compete and be judged individually. At the conclusion of this first skills challenge, the two (2) Finalists on each Team with the lowest scores as tabulated by the Finals Judges will be eliminated. At this point, twelve (12) Finalists – three (3) Finalists per each of the four (4) Teams – will remain in the Contest.

   For the second skills challenge, the remaining Finalists will again receive a 30-minute lesson on a relevant skill in the culinary arts or pastry and baking arts from an ICE chef instructor (to be selected by ICE in its sole discretion). As with the first skills challenge, remaining Finalists do not need to know how to cook or bake. The remaining Finalists will be taught the skills necessary to compete in the second skills challenge. The remaining Finalists will have a set amount of time to complete the skills challenge that will be based on the lesson given by the ICE chef instructor. They will be handed a blank scoring sheet to clearly understand the nature of the challenge, what the judges are looking for and how they will be scored. (Again, the blank scoring sheet is made a part of these Official Rules and incorporated herein by reference. Should there be any discrepancy between the scoring sheet and these Official Rules, the scoring sheet will prevail, govern and control only with respect to the Finals and in all other cases these Official Rules will prevail, govern and control. The Judges’ Scoring Sheets will again not be made public and will not be shared with the remaining Finalists. The remaining Finalists waive any and all rights they may have to review the Judges’ Scoring Sheets). Chefs from ICE, co-hosts of the Show and/or celebrity guests will then challenge each of the remaining Finalists, who will be arranged according to Teams, with a surprise market basket ingredient and an exercise/challenge in which the remaining Finalists must utilize the skill taught to them by the ICE chef instructor. Although Finalists will be arranged according to Team, each Finalist will compete and be judged individually. At the conclusion of this second and final skills challenge, the two (2) Finalists on each Team with the lowest scores as tabulated by the Finals Judges will be eliminated. Therefore, only one (1) Finalist per Team will remain and these four (4) remaining Finalists will be named the Grand Prize Winners.

9. Grand Prize Scholarships and Approximate Retail Values (“ARV”): Grand Prizes (4 winners): Each Grand Prize Winner will receive a full scholarship to The Institute of Culinary Education’s career training Program in the either the Culinary Arts or Pastry & Baking Arts, at either the New York, New York or Los Angeles, California, campuses, as selected by each Grand Prize Winner at the time of entry. ARV of each Grand Prize is $40,000 USD.

   Grand Prize Winner will not receive any cash or any other form of compensation if the actual prizes are less than the prize ARV in these Official Rules.

   ARV of Grand Prizes may exceed the actual value of the specific Program chosen by a Grand Prize Winner. In this event, Grand Prize Winner will not receive the difference in value in cash or otherwise and ICE is under no further obligation to such Grand Prize Winner.

   Each of the four (4) Grand Prize Winners will receive full tuition scholarships in either the Culinary Arts Program or Pastry & Baking Arts Program, plus necessary incidentals for the Program of choice (as determined by ICE in its sole discretion), offered at the campus of choice (i.e., books, uniforms, knives, tool-kits and a tablet computer [ICE NYC Campus only]). Grand Prize Winners will be able to redeem the scholarship at either ICE’s New York City or Los Angeles campus. All applicants to ICE (including Grand Prize Winners), at time of application, must pay the ICE application fee of $85. The $85 ICE application fee will be refunded to all four (4) Grand Prize Winners upon acceptance to and enrollment in ICE and acceptance of their scholarship. Details regarding each career training Program, including tuition rates in effect, and appropriate consumer disclosures, can be found on the ICE website at: ice.edu/career-programs. Such details are made a part of these Official Rules and incorporated herein by reference. In the event of a tuition increase, Grand Prize Winners will have no balance due for the amount of the increase; the Grand Prize Winners will receive a full tuition scholarship notwithstanding any such tuition increase.

   Within fourteen (14) days of the Grand Prize Winner notification date (“Winner Notification Date”), such Grand Prize Winners will be presented with options for potential start dates. At such time, Grand Prize Winners will have fourteen (14) days to provide ICE with their first and second choice of classes. Sixty (60) days prior to the start of each Program, the Grand Prize Winners will be advised if they received their first choice of class. If not, they are guaranteed their second choice provided such second-choice class is being offered. (If the second-choice class is not being offered, ICE will provide such Grand Prize Winner with additional class options to choose from.) Grand Prize Winners must start within 365 days (12 months) of the Winner Notification Date. Grand Prize Winners not meeting eligibility requirements by the end of the foregoing periods will be disqualified, with ICE and Administrator not having any liability or obligation of any kind. ICE reserves the right in such case to select an alternate Grand Prize Winner(s).

   Travel to and from ICE to attend a Program, room and board are not included in any scholarship prize. (Scholarship covers only tuition and certain incidentals thereto, as discussed above.) Grand Prize Winners will be required to make those arrangements on an individual basis. Grand Prize Winners in need of financial assistance or housing should contact Financial Aid at: ice.edu/admissions-financial-aid/financial-aid and/or the ICE Student Housing Program at: ice.edu/admissions-financial-aid/housing-program.

   Receipt of a scholarship will not exempt any Grand Prize Winner from compliance with all admissions requirements, rules and regulations of ICE that apply generally to all students of the Programs. The 2018 #CulinaryVoice Scholarship Contest scholarships must be applied to registration and participation in the Programs. Nothing herein will assure the Grand Prize Winners the right to continue in the Programs if s/he is not in compliance with or otherwise meet the standards of the Programs.    Total ARV of all Prizes: $160,000.

   Grand Prize Winners are not entitled to exchange or transfer prizes or to obtain cash or other substitutes, except ICE reserves the right to substitute prize or portions thereof of equal or greater value if a prize listed or any portion thereof is unavailable for any reason. All federal, state and/or local taxes are the sole responsibility of the respective Grand Prize Winners, who will each receive a 1099 tax form reflecting actual value of any prize valued at $600 or more. A Grand Prize Winner should consult his/her tax professional regarding any tax questions.

10. General Conditions and Limitations of Liability: ICE reserves the right in its sole discretion to disqualify any individual they find to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, ICE reserves the right to seek damages from any such person to the fullest extent permitted by law. ICE’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. ICE and its designees are not responsible for failed, partial or garbled computer transmissions, or for technical failures of any kind, including but not limited to electronic malfunction or damage of any network, hardware or software. If for any reason the Contest (in whole or in part) is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, fire, flood, storm or other natural cataclysm, riot, strike, civil commotion, governmental regulation or any other causes beyond ICE’s control that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, ICE reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to terminate, modify or suspend the Contest. In such event, ICE reserves the right to conduct the Contest and select the Finalists and Grand Prize Winners in a manner which is fair, appropriate and consistent with these Official Rules, as determined by ICE in its sole discretion. Notice of termination/modification/suspension of Contest will be posted on the Contest Website. No responsibility is assumed for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or loss, destruction or unauthorized access to, or alteration of, entries (including Videos); or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or electronic entry to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to Entrant’s or any other person’s computer or mobile device related to or resulting from participation in or downloading any materials from this Contest.

    If you opt to participate via your wireless mobile device, data rates may apply to your use of your wireless device according to the terms and conditions of your service agreement with your wireless carrier. Other charges may apply (such as normal airtime and carrier charges as well as charges for wireless Internet access) and may appear on your mobile phone bill or be deducted from your prepaid account balance.     Entrants further agree not to knowingly damage or cause interruption of the Contest and/or prevent others from participating in the Promotion. CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE OR WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST VIOLATES CRIMINAL OR CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, ICE MAY DISQUALIFY ANY ENTRANT MAKING SUCH ATTEMPT AND SEEK DAMAGES TO THE FULLEST EXTENT OF THE LAW.

    By participating in this Contest, each Entrant agrees: (a) to be bound by and abide by these Official Rules and the decisions of the ICE, Administrator and any judges, which shall be final and binding in all respects (such decisions include but are not limited to the tabulation of the results of the fan voting as set forth above); (b) to furnish ICE with executed copies of any documents required by ICE in order to be confirmed as a Finalist and/or Grand Prize Winner, including without limitation, any of the Contest Documents as set forth above; and (c) to release and discharge ICE, Administrator, American Broadcasting Companies, Inc., persons involved in the production (including hosts and crew) of the Show, each of their respective parent, subsidiary, affiliated, related and successor companies, advertising and promotion agencies, and each of the foregoing entities’ respective officers, directors, agents, shareholders, representatives and employees, as well as each of their respective successors, representatives and assigns (collectively, the “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from: Entrant’s participation in the Contest or any Contest-related activity (including any travel related thereto); the acceptance, possession, use or misuse of prize[s] (or portion thereof) (including any travel or activity related thereto); the substitution of the prize[s] (or any portion thereof) in accordance with the Official Rules; the Released Parties’ use of any of the rights granted in the Official Rules; and/or (1) any incorrect or inaccurate information, whether caused by Entrant’s, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind; (3) unauthorized human intervention in any part of the entry process or the Contest; or (4) technical or human error which may occur in the administration of the Contest or the processing of entries.

11. Disputes; Arbitration/Choice Of Law: Except where prohibited, each Entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Contest, or the determination of Semifinalists, Finalists and/or Grand Prize Winners, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration pursuant to the Rules of the American Arbitration Association, then effective; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys’ fees; (c) under no circumstances will Entrant be permitted to obtain awards for and Entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased; and (d) ICE shall have the right to an award of its attorneys’ fees if found to be the prevailing party. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Entrant and/or Released Parties in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of New York, without regard for conflicts of law doctrine of New York or any other jurisdiction, and all proceedings shall take place in the City of New York, County of New York.
12. Winners List: For the names of the Finalists and Grand Prize Winners (as announced on the Contest Website and on the Show), mail a self-addressed, stamped envelope to: “2018 #CulinaryVoice Scholarship Grand Prize Winners”, c/o The Institute of Culinary Education, Third Floor Marketing, 225 Liberty Street, New York, NY 10281, for receipt no later than 12/31/18.

You understand that you are providing your information to the ICE and Contest Administrator, and not to any of the aforementioned entities.
